Notable Motorcyle Verdict for Accident Attorney David M. Clark For $2.7 Million
Christopher Allen Looper was riding his 1978 Harley Davidson in Myrtle Beach, South Carolina when an Air Force bus collided with him. The bus entered his lane of travel near the intersection of South Ocean Boulevard and Springmaid Pier Road. He was struck by a twenty-eight passenger blue Air Force bus. This case was tried in front of United States Federal District Judge C. Weston Houck of Charleston by founder/owner of The Clark Law Office, David M. Clark. The testimony in court centered around the fact that the bus was being driven by an Air National Guardsman and first time visitor to Myrtle Beach.
Looper suffered extensive physical injuries as a result of the accident. He sustained fractures of his collar bone, the right elbow with a loss of two centimeters of bone, the left wrist and thumb, a fracture of his little finger, his right thigh, right heel and fractures of the toes to his right foot. He also suffered a fracture of his pubic bone, his sacrum, and his pelvis. In addition to the many fractures, Looper suffered a serious contusion of the kidney, multiple abrasions, and burns to approximately 3 percent of his body resulting in permanent scarring and disfigurement.
The government made the arguement that Mr. Clark's client, Christoper Looper, was on drugs and drunk while speeding at the time when the Air Force bus collided with his motorcycle. The case involved 2 years of litigation and a week long trial. There were numerous witnessess and expert witnesses who testified during the trial. After the trial was finished, the Federal Court stated, notwithstanding the vast resouces of the US Air Force, that David's client was not drunk or on drugs and had done nothing wrong. Dave's client was awarded $2,700,00 and the passenger on the motorcycle was awarded $580,000.
Michigan Motorcycle Accident Statistics
According to the National Highway Traffic Safety Administration and Federal Highway Administration there were 121 motorcycle accident related deaths in the State of Michigan in 2008. 88% of those drivers were wearing helmets. Many motorcycle accidents occur because the driver of a car or commercial truck simply does not see the rider on his bike. Clearly, in a match between a car and a motorcycle, there can be extensive injury to the motorcycle rider, even if he or she is wearing a helmet and other protective gear.
