The rules for a bicyclist and their rights to the roadway are set in place in order to ensure the safety of bikers. When these rules are not followed, accidents can happen. If this does occur, the person who caused the accident should be held liable and should have to pay damages. What happens, however, if the driver is claiming you did something wrong and didn't really have the right of way at all? This can create a messy situation where you (and, more importantly, your insurance companies) are fighting over who was at fault and over who has to pay.
Unfortunately, it isn't always easy to prove who had the right of way and who did something wrong. There are a few pieces of evidence you can use including:
- Your personal testimony
- A police report from the accident
- Eyewitness testimony
- Evidence from the scene of the accident
However, these pieces of evidence may or may not actually show who had the right of way. Your best bet is to call a lawyer who can help you to explore the evidence you have and who can help you to determine how best to proceed given the nature of the accident and the evidence you have available to you.
