It is almost impossible to provide a general number for how much money you will receive for emotional damages and/or for pain and suffering in a personal injury action. The reason this is so difficult is because there are so many different personal injury cases and because each individual case is different. For example, the answer to how much money will I receive after a settlement of slander/emotional pain suffering might be very different than the answer to how much you will receive for pain and suffering from a car accident or product liability case, since slander has only to do with a damaged reputation while a personal injury case can be brought when an injury causes death.
As a general matter, however, you should be aware that you have some control over how much money you will receive in any settlement. A settlement is a situation where you have grounds to sue, but you decide to handle the issue outside of court instead. The insurer or the defendant who you would be entitled to sue will offer you an amount of money they feel is appropriate based on their calculation of your damages. If you feel that amount of money is appropriate, you may choose to accept and, by accepting, give up your right to file a lawsuit. If you feel the amount of money is not appropriate, you may counter offer and continue negotiations or you may have the case decided by a jury who will assess not only emotional distress and pain and suffering, but also any actual damages you suffered like medical bills or lost income.
Because each case is different and there is no one answer to the amount of money you will get in a settlement, before accepting any settlement offer you must consult with a lawyer to make sure your rights are protected.
