Can you sue a water park for injury sustained on an attraction?

Water parks have become increasingly popular among families who like taking their children to a place where they can enjoy riding the attractions while having some fun in sun. When people become hurt due to lack of proper safety, negligent operators or poorly maintained rides, the question that most often arises is can you sue water park for injury? While the laws in each state may vary, all property owners have a legal responsibility to provide a safe, secure and clean environment for their patrons.

Most Common Types of Amusement Park Injuries

When someone has sustained injuries at a water park, the owner may be held legally responsible if they were negligent in their duty. Some of the most common accidents can include:
  • Dangerous Rides—If the owner failed to keep customers safe by not maintaining the ride properly, they may be held accountable. Often these rides have proven to be defective or poorly designed, in which case the manufacturer may be liable.
  • Negligent Ride Operators—It is extremely important that the individuals operating the rides are training properly. Poor training or supervision can result in the ride stopping short or getting stuck, leaving passengers in fear for their life.
  • Unsafe Drains—Children are most often victims of water park accidents and have died due to severe injuries caused by dangerous pool drains. In 2007, the Virginia Graeme Baker Pool & Spa Safety Act was signed into law prohibiting hazardous drains from entrapping children, resulting in fatal injuries and drowning. All drains must have a second anti-entrapment system installed in order to comply with this federal legislation that became effective as of December 19, 2008.
  • Wet or Uneven Walkways—Slip and fall accidents can happen when broken walkways have not been repaired or water combined with a slick surface causes the person to fall and become seriously injured. The owner has a legal duty to repair hazards within a specific time period. If they are aware of a dangerous condition, they must take steps to remedy the situation.
Victims have the right to sue for damages that will cover the cost of their medical treatment, pain and suffering and their lost wages when their injuries prevent them from going back to work.
